The Litigation team at Healy O’Connor Solicitors recently represented a client on appeal to the Circuit Court in relation to a charge of driving under the influence of an intoxicant. The client was found guilty in the District Court of driving a car under the influence of Nurofen Plus to such an extent as to not having control over a vehicle.
The matter went to a full re-hearing in the Circuit Court. The case raised a number of vey interesting legal issues and was unique in the sense that the Gardai claimed the client was driving while under the influence of perscription drugs. After hearing all of the evidence the Judge hearing the case was satisfied the cleint was not under the influence of drugs and acquited the client allowing the appeal. These types of cases are a new variant of the standard drunken driving cases that usually end up in Court. The outcome hear was very satisfactory for the client as the penalty for such an offence is a four year disqualification from driving.
